Petition to Sell LandTo the Hon. Lawson C. Coulson, Judge of Probate for Jackson County, the State of Alabama.
The petition of C.B. St. Clair, administrator of the estate of Thomas Bass, deceased, represents unto your Honor that the personal property of said estate is insufficient to pay the debts thereof which have been presented against said Estate. That all the personal property which has come to the knowledge or possession of petitioner has been sold under and by virtue of the order of your Honorable Court, and the proceeds thereof applied, so far as realized, together with all moneys which have come to the possession of this petitioner belonging to said estate. As the payment of the debts of the decedent and such cost and expenses as has been legally incurred in and about the prosecution of said administration and there is no other personal property out of which to pay the debt of said estate. Your petitioner further represents that the personal property is wholly insufficient to pay the debts of said estate, so far as present against said estate, and that it will be necessary for the payment of the residue of the indebtedness of said estate to sell all the following described real estate belonging to said decedent to wit - E ½ of S.E. ¼ Sect 5 Township and Range 7 East containing 80, N.W.¼ of the S.E. ¼ Section 15 T&R 7, containing 80 acres. S.W. ¼ of N.W. ¼ Section 14 T&R 7 East 40 acres, W ½ of E ¼ of Section 14 T&R 7 East 20 acres. S.W ¼ of S.W. ¼ factional Sec 14 of SE ¼ of Section 14 T&R 7 East containing 40 acres .Containing in all two hundred and twenty acres, located in Jackson County, Alabama in land abstract Huntsville, Alabama.Your petitioner further shows that said decedents ten children are his only heirs ~ to wit: G.W. Bass - Solomon Bass - J.B. Bass - Martin Bass - Nancy Stultz, wife of John Stultz - J.A. Bass (wife of Wm. Harper) - Nancy, wife of Woods Holder - Bass wife of James Crabtree - Ardelia Bass wife of Wade - Elizabeth Ann Bass, wife of Wm. Ewbanks who reside in the Sate of Indiana - the following are the children of Wade; Susan Wade, Elizabeth Crissiann, George Ira. And the children of James Crabtree and wife - John, Margaret, Elizabeth, George, Fanley, Jane, Allen Tuckett and in right of his wife Sarah Tucket.Your petitioner therefore prays that the lands above described may be ordered to be sold for the purpose of paying the debts of the said estate, and that such proceedings are decre may be had and made as may be proper and necessary to legally affect the sale of said land for the purpose aforesaid.Your petittioner further represents that it will be to the interest of said estate that said lands be sold for the purpose aforesaid.And as he will ever pray to -Sworn to and subscribed before me this 17th October, 1865.
